FAQ

Is there any deadline to claim an inheritance?

Inheritance taxes have to be paid in 6 months. Otherwise, late fees and sanctions will take place. However, you can expect to pay no inheritance taxes in Andalusia as long as you are a close relative to the deceased and the assets’ value is lower than 1,000,000€.

Is a last will necessary to claim an inheritance?

It is possible that the testator has not left a will. In fact, this needs to be verified through a query at the Spanish Ministry of Justice. Then, if there is a will, the estate will be distributed according to it and the applicable law. Nonetheless, should there be no will, a declaration of heirs is required. Then, applicable inheritance law will be applied for the purpose of distributing the estate.

Who can be an heir?

Anyone can be an inheritor as long as a valid will states so. However, inheritance law establishes certain limitations as well as “forced heirs”. A widower can be part of that group and benefit from the rights it entails.
